The website is owned and operated by NINE Retreat, LLC (“NINE”, “we”) and all content is owned or licensed by NINE. By interacting with the website, or utilizing NINE’s goods or services, you (“Attendee”) are agreeing to be subject to the Terms of Use in their entirety, without modification. If you do not agree with these terms you may not use this site or NINE’s services. If you violate these terms, we reserve the right to terminate your use or access of the site at any time, without notice.

2. The Use of Site and Services

The content of this website and the services provided by NINE are for personal and non-commercial use only. The tools, processes, strategies, materials and information presented by NINE are confidential, copyrighted, and proprietary to NINE. You may not record, duplicate, distribute, teach, or train from NINE materials in any manner whatsoever without the express written permission of NINE. Any unauthorized use or distribution of these proprietary concepts, materials, and intellectual property by you or your representatives is prohibited and NINE will pursue legal action and full damages if these terms are violated in order to protect its rights.

NINE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE WEBSITE, SECURITY OF THE WEBSITE, THE AVAILABILITY OF ANY SERVICES OFFERED ON OR THROUGH THE WEBSITE, OR THE INFORMATION, CONTENT, MATERIALS OR PRODUCTS, INCLUDED ON THIS WEBSITE. The information contained in or made available by NINE, Kym Ventola, or any of NINE’s officers, employees, interns, contractors, sponsors, speakers, teachers, representatives, or any third-party on the websites or during services NINE provides cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, mental, financial, medical, psychological, legal ethics, or legal fields. 

You accept and agree that you are fully responsible for your progress and results from NINE or any of its materials. NINE makes no representations, warranties or guarantees verbally or in writing. You understand that because of the nature and extent of NINE, the results experienced by each Attendee may vary significantly. You acknowledge that there is no guarantee you will reach your goals as a result of participation in NINE.

To be clear: You, the Attendee, alone are responsible and accountable for your decisions, behaviors, actions and the results in your business and in your personal life, and by your participation in NINE, you agree not to attempt to hold us, NINE, Kym Ventola, or any of NINE’s officers, employees, interns, contractors, sponsors, speakers, teachers, representatives, liable for any decisions, behaviors, actions or results that you make or experience in your business or in your personal life due to your participation in NINE at any time, under any circumstance.

NINE reserves the right to disallow links to its site at any time and for any reason. You agree to immediately remove and disable any links if so instructed by NINE. 

This website or other material provided by NINE may contain links to the website of a third party. These links are provided as a convenience. The content of these websites has not been reviewed or approved by NINE. You acknowledge and agree that NINE shall not be responsible or liable in any way for any damage or loss caused or alleged to be caused by use of any third-party link, content, goods or services (including, without limitation, in connection with any third-party goods or services recommended by NINE). You are responsible for reviewing and complying with the terms of use applicable to any such third-party website. 

8. Online Conduct

You agree to use this site and services only for lawful purposes. NINE requires all Attendees to be professional and respectful to our staff, location hosts, speakers, teachers, presenters, and other attendees throughout NINE, even during non-scheduled downtime and breaks. NINE reserves the right to ask the Attendee and/or their guests to leave the area where classes are being held immediately should they be deemed rude, uncooperative, unprofessional, intoxicated or in possession of alcohol or any illegal substance. In such case, the Attendee’s tuition/fees for NINE will NOT be reimbursed under any circumstances and they will NOT receive any future products, services or correspondence from NINE. 

You expressly agree that use of NINE’s website and/or and services is at your sole risk. IN CONSIDERATION FOR PARTICIPATING IN ANY IN-PERSON OR ONLINE NINE EVENT OR FOR ANY USE OF THIS WEBSITE,  YOU VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR AND HEREBY RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, AND COVENANT NOT TO SUE NINE, ITS OWNERS, MEMBERS, AGENTS, STAFF, CONTRACTORS, EMPLOYEES, VOLUNTEERS, AND all other persons or entities acting in any capacity on its behalf, as well as its successor and assigns, FOR ANY AND ALL CLAIMS, DEMANDS, ACTIONS, CAUSES OF ACTION, AND/OR LOSSES (INCLUDING BUT NOT LIMITED TO ANY EXEMPLARY, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR OTHER DAMAGES, MEDICAL EXPENSES, LOST WAGES/INCOME, LOSS OF SERVICES, LOST PROFITS, PROPERTY DAMAGE, PAIN, ILLNESS, AND DEATH) WHATSOEVER ARISING OUT OF OR IN ANY WAY RELATED TO YOUR TRAVEL TO AND/OR PARTICIPATION IN ANY NINE EVENT AND/OR MY USE OF THIS SITE OR ITS CONTENT, REGARDLESS OF WHETHER SUCH LIABILITIES ARE CAUSED BY THE NEGLIGENCE OF NINE OR OTHERWISE, AND REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW. 

11. Indemnity 

YOU FURTHER HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS NINE, ITS OWNERS, MEMBERS, AGENTS, STAFF, CONTRACTORS, EMPLOYEES, VOLUNTEERS, AND all other persons or entities acting in any capacity on its behalf, as well as its successor and assigns, FROM ANY AND ALL LIABILITIES (INCLUDING WITHOUT LIMITATION COURT COSTS AND ATTORNEYS’ FEES) THAT IT MAY INCUR AS A RESULT OF YOUR PARTICIPATION IN ANY NINE EVENT AND/OR YOUR USE OF THIS WEBSITE, WHETHER CAUSED BY THE NEGLIGENCE OF NINE OR OTHERWISE (BUT EXCLUDING ANY GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF NINE) TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW.
